1. Purpose

These Terms and Conditions of Sale (TCS) govern the relationship between Decourtdesserts, operating as a sole trader in Ireland, and its customers regarding the purchase of fresh pastries through its website. Placing an order implies full acceptance of these TCS.

2. Products

The main characteristics of the products are presented on the Decourtdesserts.com website. We reserve the right to modify the content, ingredients, and/or presentation of our products at any time by updating the product descriptions.
The choice and purchase of products are the sole responsibility of the customer. Photos, videos, and information displayed on the website or social media links are not contractual and cannot engage Decourtdesserts' liability.

Decourtdesserts offers the following fresh French pastries upon order:

  • Individual pastries, cakes for sharing, shortbread, and cookies.

  • Customizable cakes with specific inscriptions, as well as cakes for events such as weddings and birthdays.

  • Other sweet creations.

Each product is handmade and subject to availability. As Decourtdesserts is in development, we reserve the right to decline orders at any time if unable to fulfill requested quantities. Orders may be restricted or closed on the website during peak demand.

3. Delivery Area

Deliveries are made exclusively within a 20 km radius of Letterkenny, Donegal. For deliveries to other towns in the region, customers are invited to contact us via the online form.

The customer must be present at the address provided during the order to receive it, remain reachable, and notify us in case of delays. Deliveries are made exclusively in person.

4. Delivery Times and Fees

  • Delivery Times: Orders must be placed at least 4 days in advance.

  • Minimum Order Amount: €20.

Delivery Fees:

  • Free within 3.5 km of the workshop.

  • €10 for deliveries up to 10 km.

  • €20 for deliveries up to 20 km.

5. Orders and Payments

  • Orders: Orders are made exclusively through the website. An order is confirmed only after payment validation.

  • Accepted Payments: Payments are made by credit card via the secure website.

Disclaimer for Fraudulent Payments:
We take all measures to ensure secure transactions on our site. However, Decourtdesserts cannot be held responsible for the fraudulent use of a payment method by a third party. It is the user's responsibility to ensure the integrity and security of their payment method. If a problem or suspected fraud occurs, we recommend immediately contacting your bank to report the incident.

6. Cancellation, Right of Withdrawal, and Refunds

In accordance with regulations regarding perishable goods:

  • Orders for pastries cannot be canceled, refunded, or exchanged.

  • In case of an issue (damaged product or incorrect order), please contact us via the online form. Each case will be reviewed individually to find an appropriate solution.

7. Allergies and Liability

Pastries may contain allergens such as gluten, eggs, milk, nuts, etc.

  • Customer Responsibility: It is the customer's responsibility to inform us of any allergies before placing an order.

  • Disclaimer: While all precautions are taken, Decourtdesserts disclaims any liability for allergic reactions resulting from product consumption or any issues arising from improper storage or failure to adhere to the consumption deadlines indicated on the packaging.

Allergen information is provided on the packaging or upon request.

8. Force Majeure and Limitation of Liability

Decourtdesserts cannot be held responsible for delays or cancellations due to circumstances beyond its control, including but not limited to:

  • Exceptional weather conditions.

  • Strikes or disruptions in delivery services.

  • Technical failures or other cases of force majeure.

In case of a delay, the customer will be notified as soon as possible, and an alternative solution will be proposed.

9. Governing Law and Dispute Resolution

These TCS are governed by Irish law. In case of disputes, an amicable resolution will be sought. If no resolution is found, the Irish courts will have jurisdiction.
